Magistrate’s Complaint
What is a Magistrate’s Complaint
Magistrate’s Complaint is an application made by a Complainant to the magistrate courts to examine an allegation of an offence(s) and give directions for further action. This may be by way of direction the police to conduct investigations or the complainant to proceed to commence a private prosecution against the alleged offender.
Anyone who believes that a criminal offence has been committed against them can file a Magistrate’s Complaint. These offences include as follows: –
- Voluntarily Causing Hurt
- Harassment
- Mischief
- Cheating
- Breach of Protection Order under the Protection from Harassment Act
- Breach of Special Direction / Exclusion Order under the Community Disputes Resolution Act
- Neighbour Dispute
- Other Offences
The Complainant should first make a police report and check if your case is eligible, before filing a Magistrate’s Complaint to the State Courts.
